1. INTRODUCTION AND DEFINITIONS

1.1 These General Conditions govern all terms and conditions regarding the provision of services offered by beercoasters.club (hereafter the "Services"). Beercoasters.club is a cultural association whose purpose is to study, discover, catalog, and where possible to preserve the testimonies of the industrial brewing activity in the world.

 

 

2. REGISTRATION. 

 

2.1 Entry to the Services offered by beercoasters.club is free for Editors.  The annual subscription is required to Super User and User and the acceptance of these General Terms and Conditions. In order to access the services offered, the User must fill out the registration form.

 

2.2 The User agrees to provide his / her name, personal details, email address, and any other required information in a correct and truthful manner. Moreover, User agrees to update his registered master data, including your e-mail address, to result available at any time.

 

 

3. DURATION AND WITHDRAWAL

 

3.1 The delivery of the Services will be effective from the date of registration by the User and will be understood annually, except the User's right to withdraw and waive the use of the Service. The withdrawal by the User may be effected at any time and with immediate effect by means of written communication sent to beercoasters.club, by e-mail at info@beercoasters.club.

 

3.2 In the event of any breach by the User of any of these General Conditions, beercoasters.club reserves the right, without any prior notice, to discontinue the provision of the Services to the User.

 

3.3 Any complaints about the operation of the Service can be sent by e-mail to info@beercoasters.club.

 

 

 

4. USE OF SERVICES

 

4.1 The right to use the Services offered by beercoasters.club is personal and is not transferable to any other person than the User.

 

4.2 After completing the registration process, the User will have a personal account, accessible through an anonymous ID (User ID) and a password (password). The keywords are strictly personal and confidential. The User agrees not to divulge the keyword for any reason. User will be responsible for any actions and behaviors that are in conflict with laws or with these General Terms and Conditions. User agrees to promptly report to beercoasters.club any misuse by a third party of own account or keywords.

 

4.4 It is expressly forbidden to use or transmit, through the Services, any kind of material that infringes third party rights, which is contrary to law, public order and goodwill, which is threatening, offensive and/or defamatory, which violates the rights inherent in public and private life, whether vulgar, obscene, blasphemous or otherwise inappropriate, that incites criminal acts, actions that are the cause of civil liability, to acts which are otherwise illegal and which, without the prior express approval by beercoasters.club, contain promotional or advertising messages.

 

4.5 Beercoasters.club reserves the right to check the contents of the Services, including forums, to verify that it is in compliance with the General Terms and Conditions and applicable laws.

 

 

 

5. LIMITATION OF RESPONSABILITY

 

5.1 Beercoasters.club excludes any liability for any damage or accident arising out of the provision of services caused by any malfunction, omission, cancellation, interruption, error, default, operational and transmission delay, computer viruses, malfunction of the line communication, theft, destruction, unauthorized access, alteration and use of documentation.

 

5.2 The User expressly acknowledges that beercoasters.club will not be held liable for any defamatory, offensive, and illegal conduct by other Users or third parties during the exchange and trading relationship of breweriana materials and that the risk of any damage is entirely under the personal responsibility of the User himself.

 

5.3 The beercoasters.club website may contain hypertext links referring to other Internet sites. Beercoasters.club can not be responsible for the content of external sites, the functioning of access to these sites, the relationship between the User and the owners of these sites.

 

 

6. REGISTERED BRANDS

 

6.1 "beercoasters.club" and each logo on this site constitutes a registered trademark of [.].

 

6.2 All other brands appearing on beercoasters.club belong to their respective owners.

 

 

 

7. AUTHOR RIGHTS

 

7.1 "Beercoasters.club" contains copyrighted material, trademarks and other information, including text, photos, videos, software, graphics, music, sounds, and more that are subject to private ownership.

 

7.2 It is expressly forbidden for the User to modify, publish or transmit such material and to use its contents, either in whole or in part, without the prior written consent of beercoasters.club.

 

7.3 User agrees not to introduce any copyright, trademark, or proprietary third party copyrighted material unless expressly authorized by the owner. The burden of determining whether the material is not subject to any copyright is by the User, who will be the only responsible for any damages caused by the violation of any copyright, private ownership, and any other damage caused by the material he proposed.

 

7.4 The User acknowledges to beercoasters.club the right to copy, reproduce, review, publish and distribute any material from the User made available in this site.

 

 

 

8. MODIFICATION TO GENERAL CONDITIONS

8.1 Beercoasters.club reserves the right to change or modify these General Conditions. Any such changes, modifications, cancellations, and additions will be deemed effective immediately after they have been communicated. Such communication can be made through a note on Beercoasters.club, or by e-mail. From that moment, any access and use by the User of Beercoasters.it will be interpreted as a complete acceptance of such changes, modifications, and additions.

 

9. BEERCOASTERS

 

9.1 Beercoasters are classified by Country, City, Brewery, Brand, and Year. Coasters accepted are exclusively related to BEER or MALT BEVERAGES brands or reporting a logo of a brewery.

 

     9.1.A The list of Countries is developed by referring to the list of sovereign countries issued by the United Nations Organization and the list of NSGT (Non-Self-Governing-Territories) included in the Chapter XI of the UN Charter. A NSGT is a territory deemed by the United Nations General Assembly (UNGA) to be “non-self-governing”. The interests of the occupants of dependent territories are paramount and requires member states of the United Nations, in control of such territories, to submit annual information reports concerning the development of those territories. For the above, the list can be updated every year.

 

 

9.2 Beercoasters related to beers brewed UNDER LICENSE will be included in the country where the process is done. Ex: Stella Artois is brewed in Argentina under license by Cerveceria y Malteria QUILMES, coasters are listed under this brewery.  

 

9.3 Beercoasters related to beers IMPORTED will be listed in a specific space. The coaster should have clear proof of its origins such as writing in original language or address.

 

9.4 BEER FIRM is considered a normal brewery. Beer coasters will be included in the city where the beer is sold or where Beer Firm has got a deposit.

 

9.5 Beercoasters issued by CONTRACTOR or CLIENT BREWERY will be included in catalogs as well. Each Editor has faculty to include them in the cities or to list them in separate spaces.

11. PRIVACY POLICY (art. 13 of EU Regulation 679/16)

 

pursuant to art. 13 of EU Regulation 679/16 therefore GDPR privacy, a regulation that regulates the protection of people and other subjects regarding the processing of personal data of which the Association Beercoasters.CLUB will enter into possession, we inform you of the following:

 

1. PURPOSE OF DATA PROCESSING.

The treatment is finalized solely for the realization of the institutional purposes promoted by the association itself within the limits of the statutory provisions envisaged and in compliance with the GDPR privacy 679/16.

 

2. METHOD OF DATA PROCESSING.

a. The treatment is carried out by means of the operations or set of operations indicated in art. 5 paragraph 1 GDPR privacy: collection, registration, organization, conservation, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and distribution of data;

b. Operations can be performed with or without the support of electronic or automated tools;

c. The treatment is carried out by the owner and / or the persons in charge of the treatment.

 

3. PROVISION OF DATA.

The provision of personal data is strictly necessary for the purposes of carrying out the activities referred in point 1.

 

4. REFUSAL TO PROVISION OF DATA.

Any refusal by the interested party to provide personal data in the case referred in point 3 will make it impossible to carry out the activities referred in point 1.

 

5. DATA COMMUNICATION.

The personal data will be known by the persons in charge of processing and may be communicated for the purposes referred in point 1 to external collaborators and, in general, to all those subjects to who necessary for the correct accomplishment of the purposes indicated in point 1.

 

6. DIFFUSION OF DATA.

Personal data are not subject to disclosure.

 

7. TRANSFER OF DATA ABROAD.

Personal data may be transferred to countries of the European Union and to third countries with respect to the European Union for the purposes referred to in point 1.

 

8. RIGHTS OF THE INTERESTED PARTY

Article. 13 and following GDPR privacy grants the interested party the exercise of specific rights, including that of obtaining from the holder confirmation of the existence or otherwise of their personal data and their being made available in an intelligible form; the interested party has the right to have knowledge of the origin of the data, of the purposes and methods of the processing, of the logic applied to the processing, of the identification details of the data controller and of the subjects to whom the data may be communicated; the interested party also has the right to obtain the updating, rectification and integration of data, cancellation, transformation into anonymous form or blocking of data processed in violation of the law; the interested party has the right to object, for legitimate reasons, to the processing of data.

The data controller is the Association Beercoasters.CLUB with its registered office in St. Paterno 45a, Villa Adriana (Roma), Italy.
